Court allows 5-day custody for KP Sharma Oli and Ramesh Lekhak in criminal negligence case

KATHMANDU: The Kathmandu District Court has granted permission to police to keep former Prime Minister KP Sharma Oli and former Home Minister Ramesh Lekhak in custody for five days for investigation.

The order was issued by Judge Ananda Shrestha, allowing authorities to proceed with custodial interrogation as part of an ongoing criminal probe.

Police had arrested both Oli and Lekhak on Saturday morning and presented them before the court on Sunday following their detention on Chaitra 14.

The arrests were carried out in line with a Cabinet decision to implement recommendations made by an investigation commission led by Gauri Bahadur Karki. The commission had submitted its report on Chaitra 24, recommending criminal action against the two leaders.

According to officials, both have been booked under provisions of the Muluki Criminal Code (National Penal Code)—specifically Sections 181 and 182.

Section 181 relates to causing death through negligence, which carries a penalty of 3 to 10 years in prison along with a fine ranging from Rs 30,000 to Rs 100,000. Section 182 deals with causing death through recklessness, punishable by up to 3 years in prison and a fine of up to Rs 30,000.

Authorities say the investigation will focus on determining accountability based on the commission’s findings, with further legal proceedings expected after the custodial period.
