House of Representatives approves public procurement (second amendment) ordinance

KATHMANDU: The House of Representatives has approved the Public Procurement (Second Amendment) Ordinance, 2083, clearing the way for the government to introduce a replacement bill to formalize the revised procurement framework.

The ordinance was issued by the government during a parliamentary recess and was tabled in the House on Baisakh 28, 2083, the opening day of the federal parliament session.

Opposition parties had raised objections, arguing that the government should have introduced a bill instead of promulgating an ordinance.

During the session, Khadk Bahadur Budha, a lawmaker from the Nepali Congress, proposed that the ordinance be rejected.

However, Speaker of the House did not pass the rejection motion after it failed to secure parliamentary approval.

Subsequently, on behalf of Prime Minister Balen Shah, Minister for Law, Justice and Parliamentary Affairs Sobita Gautam presented a motion seeking approval of the ordinance. The House later endorsed it by majority vote.

Path Opens for Replacement Legislation

With parliamentary approval secured, the government can now proceed to introduce a replacement bill to convert the ordinance into permanent law.

The ordinance must be replaced by legislation within 60 days of being tabled in Parliament. The replacement bill must be passed by both houses of the federal legislature and receive presidential authentication to become law.

Failure to complete the process within the constitutional timeframe would render the ordinance automatically ineffective, along with all amendments introduced through it.

The approval of the ordinance marks another step in the government’s ongoing effort to streamline and reform Nepal’s public procurement system, which plays a critical role in infrastructure development and public spending efficiency.
