KATHMANDU: The Department of Land Management and Records has directed land administration offices across the country to conduct on-site monitoring and inspection of companies, industries, institutions and organizations that have received government approval to acquire or retain land beyond the legally prescribed landholding ceiling.
The department has instructed concerned land administration offices in 40 districts to conduct field inspections and submit detailed reports after examining the actual status of such landholdings.
The directive comes after the department repeatedly sought reports from the concerned offices but received submissions from only a limited number of them. The department has now instructed the monitoring and inspection committees to visit the sites themselves, assess the actual situation and submit the required reports.
According to the directive, industries, companies, establishments, projects, educational institutions and other organizations that have acquired land exceeding the prescribed ceiling with government approval must be inspected to determine whether the land is being used for the purpose for which approval was granted.
The department said the field-level investigation is required under existing legal provisions governing land above the prescribed ceiling.
The latest directive was issued after most concerned offices failed to submit reports despite repeated correspondence from the department.
Under the Land Act, the concerned monitoring committees are responsible for regularly monitoring and inspecting institutions that have received government permission to hold land beyond the prescribed ceiling.
The law requires such inspections to be carried out in coordination with the respective local governments within two months after the end of each fiscal year. The actual status of land use must then be documented and a report submitted to the Department of Land Management and Records.
The department has instructed the concerned offices not to delay the process and to deploy their teams to the field to complete the monitoring and inspection.
The offices have also been directed to submit reports clearly stating whether the land is being used in accordance with the purpose for which government approval was granted.
